Background

The Shire has received a development application for a Shop (Hardware Store) and Showrooms at 44 (Lot 256) and 34 (Lot 100) Clarke Road, Margaret River.

The application will be assessed though the Development Assessment Panel (DAP) pathway. The decision maker for this application will be the DAP, not the Shire. As part of the DAP process, the Shire is required to submit a Responsible Authority Report (RAR) and is seeking community input to support the preparation of this report.


About the Proposal

The development will consist of two separate buildings labelled on the plans as follows:

  • Building 1 – 5,055m2 single tenancy hardware development inclusive of a central warehouse area, outdoor nursery trade display areas.
  • Building 2 – 6,854m2 divided into 8 separate showroom/large format retail tenancies.
  • The development is orientated around a central carparking area with a peripheral service access on the outside of the buildings. Some remnant vegetation has been retained on the north-eastern boundary, and planting has been proposed on the north-western and south-eastern boundaries.

    The applicant has been granted environmental approvals for land clearing from the federal government, and the proposal has been referred to the EPA. The EPA have not assessed the proposal owing to the federal government decision and environmental impacts being considered through the planning process.

    The proposal presents the following variations to the planning rules:

  • At its highest point, Building 2 will be 10.3m above natural ground level, in lieu of the maximum 10m building height permitted by Local Planning Scheme No.1 (LPS1).
  • LPS1 requires the provision of 1 tree per every six (6) parking bays. This translates to 44 trees being required in the parking areas of the site. The applicant has incorporated 19 trees (shortfall of 25 trees).
  • The development incorporates a 3.685m front setback in lieu of 10m as required by LPS1.
