This survey was open for community comment for three weeks over late October 2016. This lease is scheduled to go to Council for consideration on Wednesday 10 May 2017.

Background

Reserve 18838 has been leased to the Margaret River Hot Rod Club for the purpose of a speedway since 1978. View the location here. The speedway was leased on a term of 10+10 years which has been extended to the 16 May 2019. The Shire is now considering whether to further extend the lease for the speedway for an additional 10+10 years (20 years total) period.

The Speedway operates under a noise "exemption order" which was issued in the year 2000 by the Minister for the Environment, which allows the speedway to exceed the prescribed noise levels set under the Environmental Protection (Noise) Regulations 1997. Extension of lease and community consultation

Without the exemption order the Speedway would be in breach of the Environmental Protection (Noise) Regulations 1997. The Shire does not have any ability to vary, add conditions to, or revoke the exemption order. This can only be done by the Minister of Environment. However, the Shire does have the power to renew or refuse to renew a further lease.

Relocating the speedway has been explored and is not a feasible option, therefore a refusal to renew the lease would mean there would be no Speedway within the Shire of Augusta Margaret River.
