  • Draft Local Planning Policy No. 7 - Short Stay Accommodation

    The Shire is advertising a draft amendment to Local Planning Policy No.7.

    The amendment will remove the ability for grouped dwellings to be used for holiday house purposes within proximity to the Margaret River Town Centre (as shown on policy plan 1). As an owner of a property falling into this category, the Shire is notifying you of this change as it may affect the use of your property into the future.

    The purpose of the change is to ensure that sufficient smaller, well located and more affordable long term rental accommodation continues to be available for that purpose.

    The changes would apply to new applications only. If you have an existing holiday house approval, these will continue to be honoured and you will still be able to apply for renewal of your approval. However please note, that if your approval expires (i.e. you do not apply for a renewal 3 months prior to it lapsing) then a new application is unlikely to be approved if the proposed changes are adopted.

  • Draft Local Planning Policy No. 1 - Outbuildings, Farm Buildings and Swimming Pools

    Modifications are proposed to the Local Planning Policy No.1, with the aim of reducing the number of planning applications required for sheds and water tanks. Below is a summary of the key changes:

    • Floor area limits changed to relate to lot size rather than a single requirement for each zone;
    • Relaxation of the 5m side setback requirement where sheds and water tanks are located behind the dwelling on R5 and lower coded lots;
    • Clarification on wall height measurement for different roof types, particularly skillion roofs.

  • Modification to Existing Structure Plan - Lots 11 & 12 Redgate Road, Witchcliffe

    Modification to existing Structure Plan for Lots 11 & 12 Redgate Road, Witchcliffe is presently being advertised for public inspection and comment.

    The proposal involves a modification to the structure plan previously approved in 2010. The key changes proposed are summarised below:

    • Reduced density of development, resulting in 66 less lots than previously approved (115 lots in the2010 structure plan, 49 lots currently proposed).
    • Use of on-site effluent disposal as opposed to reticulated effluent disposal.
    • Reconfiguration of the layout to the western side of the site to keep development within the property.
    • One additional access point and additional emergency access point onto Redgate Road.

  • Proposed Winery, Restaurant, Cellar Door and Ancillary Events (4 events per year) - Have Your Say

    The shire has received a Development Assessment Panel (DAP) application for a Winery, Restaurant, Cellar Door and Ancillary Events (4 events per year) at 168 (Lot 2953) Clews Road and 261a (Strata Lot 1) Fifty One Road, Cowaramup.

    Prior to considering the application further, the shire invites you to have your say.


    Items of particular note are the variations to the proposed Winery building that exceeds the 8m ridge height standard by 4m and the 7m wall height standard by 4m.

    Any person wishing to comment should do so in writing or by email to spdplanning@amrshire.wa.gov.au on or by the closing date advised above and by quoting the relevant P Number.

    Final determination on the application will be made by the southern ‘Development Assessment Panel’ (DAP). The DAP process was enacted in 2011 and provides an independent panel for the consideration of major development applications in WA. The DAP is comprised of three technical specialists and two Councillors from the Shire.

    The development application will be assessed by the Shire as per an ordinary application, with the Shire’s role concluded after Council makes its recommendation to the DAP.

  • Modification to Witchcliffe Eco Village Structure Plan

    Lot 1500 (formerly Lot 2812 & Lot 2807) Bussell Highway, Witchcliffe (P220774)

    The Modification to the Witchcliffe Eco Village Structure Plan was out for public advertising and comment, the consultation period for this application has now closed and the proposal is being assessed by Shire Staff.

    Any person who submitted a submission on the application will be informed when the application is going to be presented to Council.

    The Shire will prepare a recommendation on the proposal which is forwarded to the West Australian Planning Commission who make the final decision on the proposal.

    Brief Summary of Modifications to the Structure Plan consist of 4 key changes which are:

    1. Changing the density code of residential land along Bussell Highway from R5-10 to R30-40.

    2. Changing specified lots identified as ‘Residential’ to ‘Tourism’

    3. Increasing Residential R30 Aged and Dependent Housing site by 1093m2; and reducing the size of the adjacent POS by the same amount

    4. Shifting boundaries between land zoned Special Use: Ecovillage Common and Special Use: Ecovillage Agricultural Lots, with a net increase of 12,874m2 going to Special Use: Ecovillage Common.
